1. Acceptance and Modification of Terms

1.1 Agreement to Terms. By accessing, scheduling, or utilizing any services provided by MasterFix Appliance Repair, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions contained herein.

1.2 Modifications. We reserve the unilateral right to modify, amend, or update these Terms at any time without prior notice. Material changes will be posted on our official website with an updated effective date. Your continued use of our services following such modifications constitutes acceptance of the revised Terms.

2. Service Scope and Limitations

2.1 Service Area. MasterFix provides professional appliance diagnosis, repair, and maintenance services exclusively within North West Houston and its contiguous metropolitan areas. Services outside this designated territory may be subject to additional travel fees or availability constraints.

2.2 Service Limitations. Our services are limited to appliances that are structurally sound, safely accessible, and installed in compliance with local building and safety codes. We reserve the right to refuse service for appliances deemed unsafe or located in hazardous conditions.

3. Appointment Protocols

3.1 Scheduling and Availability

Appointments are scheduled based on technician availability and service area routing. While we endeavor to accommodate same-day service requests, availability is not guaranteed and is offered on a first-come, first-served basis.

3.2 Cancellation and Rescheduling Policy

Cancellations or rescheduling requests must be submitted with a minimum of 24 hours' notice prior to the scheduled appointment time. Cancellations with less than 24 hours' notice or technician no-access situations may incur a cancellation fee equivalent to our standard diagnostic charge.

3.3 Arrival Windows

We provide estimated arrival windows. While we make every reasonable effort to maintain punctuality, circumstances including traffic, prior service complexities, or emergency repairs may necessitate schedule adjustments. We commit to proactive communication regarding any significant delays.

4. Financial Terms

4.1 Fee Structure

A non-refundable diagnostic fee is required at the time of service commencement. This fee may be applied toward the total repair cost if you authorize and proceed with our recommended repair services.

4.2 Estimates and Final Authorization

Written or verbal estimates are provided based on visible and described symptoms. You retain the right to approve all repairs and associated costs before work commences. If additional issues are discovered during the diagnostic or repair process requiring work beyond the original estimate, we will obtain your explicit authorization before proceeding, which may adjust the final invoice.

4.3 Payment Terms

Payment in full is due immediately upon completion of services, prior to technician departure. We accept major credit cards (Visa, MasterCard, American Express), cash, and personal checks. Checks returned for insufficient funds will incur a $35 processing fee.

5. Warranties and Guarantees

5.1 Repair Warranty

All repairs performed by MasterFix are backed by a 90-day warranty on both parts and labor ("Warranty Period"), commencing from the service completion date. This warranty covers defects in materials supplied by us and workmanship performed by our certified technicians.

5.2 Warranty Exclusions

The warranty is expressly limited and does not extend to:

• Pre-existing conditions or unrelated component failures
• Damage resulting from misuse, abuse, neglect, or improper maintenance
• Components not supplied or installed by MasterFix
• Consequential or incidental damages
• Repairs altered, modified, or attempted by unauthorized third parties following our service
• Normal wear and tear or cosmetic issues

5.3 Service Satisfaction Guarantee

We are committed to your complete satisfaction. If you are dissatisfied with any aspect of our service, contact us within 48 hours of service completion. We will make commercially reasonable efforts to inspect and address any legitimate concerns related to our workmanship at our discretion.

6. Liability and Indemnification

6.1 Limitation of Liability. To the maximum extent permitted by Texas law, MasterFix's total aggregate liability for any claims arising from or related to services rendered shall be strictly limited to the total amount paid by you for the specific service giving rise to the claim. Under no circumstances shall we be liable for indirect, incidental, special, consequential, or punitive damages.

6.2 Customer Indemnification. You agree to indemnify, defend, and hold harmless MasterFix, its employees, and agents from any claims, damages, losses, or expenses arising from: (a) your breach of this Agreement; (b) your negligence or willful misconduct; or (c) conditions existing prior to our service visit.

6.3 Force Majeure. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, utility failures, supply chain disruptions, or government actions.

7. Customer Obligations

To facilitate safe and efficient service, you agree to:

• Provide accurate and complete information regarding appliance symptoms, history, and environment
• Ensure safe, unobstructed access to the appliance and its utilities (power, water, gas)
• Clear a minimum 3-foot perimeter around the appliance for technician workspace
• Secure all pets in a separate, enclosed area for the duration of the service visit
• Have an authorized adult (18+) present for the entire service duration
• Disclose any known safety hazards or environmental concerns (e.g., mold, asbestos, pests)

8. Technician Standards

Our technicians commit to:

• Presenting company identification and wearing branded uniforms
• Using protective floor coverings and taking precautions to protect your property
• Performing services in a professional, workmanlike manner consistent with industry standards
• Providing a clear explanation of the diagnosis, recommended repairs, and preventative maintenance advice
• Leaving the work area in a clean and orderly condition upon completion

9. Parts and Materials

We utilize new, high-quality, manufacturer-approved or equivalent replacement parts. We source parts from reputable suppliers and warrant them according to the manufacturer's specifications. The use of aftermarket or refurbished parts, when necessary, will be disclosed and require your prior approval.

10. Promotional Offers

Discounts, coupons, and promotional offers ("Promotions") are valid only under their specific published terms, for a limited time, and may not be combined unless explicitly stated. We reserve the right to modify or discontinue any Promotion at any time without notice. Promotions cannot be applied retroactively to completed services.

11. Intellectual Property

All content, including but not limited to text, graphics, logos, service marks, website design, and the collective "look and feel" of our digital and print materials, is the exclusive property of MasterFix Appliance Repair or its licensors and is protected by United States and international intellectual property laws. Unauthorized use, reproduction, or distribution is strictly prohibited.

12. General Provisions

12.1 Governing Law and Venue. This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any legal action or proceeding shall be brought exclusively in the courts located in Harris County, Texas.

12.2 Severability. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.3 Entire Agreement. This document constitutes the entire agreement between you and MasterFix regarding the subject matter herein and supersedes all prior or contemporaneous communications, proposals, or agreements, whether oral or written.
